The Minister of Economy and Finance, Nadia Fettah, presented Friday, before the members of the Committee on Finance and Economic Development in the House of Representatives, the bill n ° 41.22 modifying and supplementing the law n ° 20.13 relating to the Competition Council.
This fact, she indicated that the said project aims to strengthen the neutrality of the Council, as a constitutional institution and to improve the procedures for referral to the Council, the objective being to set up an integrated national ecosystem of competition, in accordance with the New Development Model (NMD).
Thus, the bill also aims to set the missions and prerogatives of the members of the Board and to improve procedures and management, just as it also stipulates the clarification of the powers of the Chairman of the Board as well as his various decision-making bodies, to avoid any overlapping of competences, by empowering the Council’s internal regulations to distribute the prerogatives between the aforementioned bodies.
In addition, the text allows members at the end of their mandate to continue to exercise their functions until the appointment of new members, to avoid any disruption of the work of the Council, and also gives it the possibility of disseminating guiding principles on various issues.
Concerning the improvement of procedures and management, it will enable the Competition Council to monitor conflicts of interest in the cases referred to it, concerning members and the general rapporteur, and set up a dispute procedure to members and rapporteurs.
The draft law also sets the conditions relating to the quorum in the different structures of the Council, emphasizing the commitment to confidentiality of the deliberations of the decision-making bodies in which only the members concerned can participate.
