The 15 days off approved by the CG

The Council of Government approved, during its meeting of this Thursday, May 19, 2022, the bill relating to the general statutes of the public service.

This project, of which MoroccoLatestNews has taken noteis part of the social agreement signed on April 30, 2022 between the government, the most representative trade union centers and the General Confederation of Moroccan Enterprises (CGEM), with the aim of promoting the rights of employees, men and women, and to reconcile professional and private life, in accordance with the principle of co-responsibility on which the Moroccan family is based.

A principle also confirmed by King Mohammed VI in his speech of October 10, 2003 on the occasion of the opening of the second legislative year of the 7th legislature 2003-2004, before it was included in the Family Code .

This project aims to approve certain measures and procedures aimed at enshrining rights related to maternity and custody of children, in accordance with the content of International Convention No. 183 concerning the revision of the Maternity Protection Convention adopted by the General Conference of the International Labor Organization at its 88th session, which Morocco ratified on April 13, 2011.

It also aims to approve new requirements that will allow a male employee who has a child of his own or who has been entrusted with the guardianship of a child under fourteen weeks of age to benefit from paternity leave for a period of 15 continuous and paid days, in order to enable him to participate in family life and to provide the necessary care for the mother and the newborn child or the child in his care, in particular during the first days of his life.

The employee concerned benefits from this leave at his request and for the period running from the date of birth of the child or the transfer of guardianship until the newborn or the sponsored child reaches 14 weeks.

This bill also provides that an employee, who has been entrusted with the guardianship of a child under 14 weeks of age, in accordance with the legislative and regulatory texts in force, benefits from a guardianship authorization which extends from the date of grant until the child reaches the aforementioned age.

The text also provides that an employee who has given birth or who has been entrusted with the care of a child benefits from a breastfeeding authorization whose duration is determined in one hour per day, from the date of exhaustion. of the license granted for birth or guardianship, until the newborn or the sponsored child reaches the age of 24 months, provided that the administration determines the deadlines for benefiting from this license according to the wishes of the employee concerned, taking into account the proper functioning of the establishment.
