The Ambassador Permanent Representative of Morocco to the UN, Omar Hilale, spoke Wednesday before the 4th Committee of the United Nations General Assembly. He said on this occasion that the decolonization of the Moroccan Sahara has been “irreversibly” sealed since 1975, after the Madrid Agreement.
The continuation of the examination of the question of the Moroccan Sahara by this Commission, maintained the diplomat, is “anachronistic”, because “the decolonization of this part of Morocco was already definitively sealed in 1975, following the signature of the Madrid Agreement, November 14, 1975, with the former colonial power, Spain, in accordance with Article 33 of the UN Charter ”.
This Agreement was duly consigned to the UN SG on November 18, 1975, and validated by the United Nations General Assembly, in its resolution 3458B, of December 10, 1975, recalled Omar Hilale, who also noted that the said agreement “fully meets the requirements of the General Assembly, which advocates a political solution, negotiated between the colonial power – Spain – and the party entitled – Morocco -. This gives it legal legality, historical strength and political legitimacy, as a final act of decolonization of the Moroccan Sahara ”.
In this sense, the Ambassador noted that the Security Council has just adopted resolution 2602 on the question of the Moroccan Sahara, by which he reaffirmed, as he has systematically done in all its resolutions since 2004, that the solution to this regional dispute can only be political, realistic, pragmatic, lasting and compromise.
To this end, he continued, the Council asked the new Personal Envoy of the Secretary General for the Moroccan Sahara, Staffan de Mistura, to resume the facilitation of the political process of the round tables, with its 4 participants, Morocco, Algeria, Mauritania and the Polisario.
Thus, he said again, the executive body of the UN has, once again, reaffirmed the preeminence, the seriousness and the credibility of the Moroccan Autonomy Initiative, which constitutes the only solution to this regional dispute, within the framework of the sovereignty and territorial integrity of Morocco.
And Omar Hilale to add: In doing so, the Security Council has assumed its responsibility for preserving international peace and security, by confirming the path already mapped out for the peaceful settlement of this regional dispute, and on the contrary, ” the focus of Algeria and of certain delegations, here at the 4th Committee, on an ideological and obsolete approach for the settlement of the Moroccan Sahara issue, is detached from the historical, political, legal and human realities of this dispute because it takes up theses and dead and definitively buried plans ”.
Concluding his intervention, the diplomat noted that “while the speech of Algeria clings to the past, the resolutions of the Security Council are projected towards the future, by working in favor of a political solution to this dispute regional “
And it is precisely in order to protect the UN from this statutory dichotomy and this political gap, he recalled, that the Founding Fathers of the international organization instituted Article 12 of the Charter of the United Nations, which prohibits the General Assembly and its Committees from making recommendations or even examining issues on the Security Council’s agenda.
