Six decisions have reinforced the legal framework for the legal use of cannabis following their publication in the Official Bulletin (BO). The program for the legal use of cannabis, launched by Morocco through the publication of the aforementioned law, has fundamental objectives including the establishment of a legal framework allowing the development of circuits for the medical and industrial use of cannabis. in accordance with the Kingdom’s international commitments.
Exploiting the opportunities offered by this market to attract international operators, supporting investment in the processing and industrialization of products extracted from cannabis, as well as the gradual reorientation of illegal crops that destroy the environment towards sustainable legal activities that produce value and job opportunities are not left out.
However, the decisions mainly represented in Law No. 13.21 on the legal uses of cannabis, specify in particular the method of issuing licenses related to the legitimate uses of this substance, the methods of collection and destruction of impurities, the approval of seeds and seedlings, damage and other reporting and the licensing process. The Orders drawn up on the basis of joint decisions by the Minister of the Interior, the Minister of Health and Social Protection, the Minister of Agriculture, Fisheries, Rural Development, Water and Forests and the Minister of 1293.22, 1294.22, 22 100, 1296.22, n° 1297.22, 1298.22 dated 11 choual 1443 (May 12, 2022), specify the terms and conditions such as the issuance of licenses to practice cannabis-related activities .
But not only since the texts also define the models of the contract for the sale of cannabis crops, the minutes of delivery of the crops mentioned and the registers for the destruction of surplus production of cannabis, its seeds, plants, crops. and products, the terms and conditions for the approval of seeds and seedlings of cannabis by the National Agency for the Regulation of Activities Related to Cannabis, the forms of registers and the terms for their issuance by the National Agency for the Regulation of Activities related to cannabis and holders of cannabis-related licenses, determine the proportions of Tetrahydrocannabinol (THC) provided for in Articles 6 and 17 of Law No. 13.21 on the legal uses of cannabis and the procedures for reporting damage and losses that may affect crops of cannabis.
The legal arsenal for the application of Law 13.21 also includes Decree No. 2.21.642 implementing Articles 32 and 35 of Law 13.21 relating to the legal uses of cannabis, which specifies the supervision of the National Agency for regulation of Cannabis-related Activities represented by the Ministry of the Interior, taking into account the powers and competences applicable to public establishments. By Decree No. 2.22.159, this arsenal also sets the regions in which it is authorize activities related to the cultivation, production, establishment and exploitation of cannabis (Al Hoceima, Chefchaouen and Taounate) with the possibility of adding other provinces according to the interest shown by national investors international organizations with respect to activities related to the cannabis production chain.
As part of the incentive to invest in this area, the said decree entrusts the National Agency for the Regulation of Cannabis-related Activities with supporting license applicants and facilitating the implementation of administrative procedures related to its granting, in accordance with the provisions of the aforementioned law, and this in close coordination with all the players concerned.
The first meeting of the Board of Directors of the National Agency for the Regulation of Cannabis-Related Activities (ANRAC) was held on Thursday in Rabat, under the chairmanship of the Minister of the Interior, Abdelouafi Laftit, in application of the provisions of Law 13.21 relating to the legal uses of cannabis. ANRAC ensures the implementation of the State strategy in the field of cultivation, production, manufacture, processing, marketing, export of cannabis and import of cannabis. its products for medical, pharmaceutical and industrial purposes.
