However, his extradition remains dependent on the promulgation of a decree signed by the Head of the Executive, on the proposal of the Minister of Justice.
In response to requests from the CNDH, the government explained that the arrest of the Chinese national was made on the basis of an Interpol red notice to which he was the subject and which had been issued at the request of Beijing, which l ‘accuses acts linked to terrorism, which are also criminalized by Moroccan law.
The person concerned, add the Moroccan authorities, was informed by the police of the reasons for his arrest, and that he was the subject of an international arrest warrant issued against him by the authorities of his country for related reasons. to terrorism.
And to emphasize that the trial of the Chinese citizen takes place in compliance with international law, in the sense that he is defended by a certain number of lawyers, that he can communicate with them and that he has access to an interpreter. to facilitate communication with him.
Note that the decision of the Court of Cassation has sparked much controversy and many UN human rights experts have invited the Moroccan executive to suspend its decision to extradite Yidiresi Aishan to China where he risk of serious human rights violations, including arbitrary detention, enforced disappearance, or torture and other cruel, inhuman or degrading treatment or punishment.
For his part, Yidiresi’s lawyer, Me Miloud Kandil, was confident of a “political decision” with regard to the extradition request.
“We really hope that a political decision is taken and we are convinced that reason will prevail. Our country’s credibility is at stake because it is in its interest to defend the right to life, in the eyes of the world, ”he told MoroccoLatestNews FR.
The lawyer also recalled the cancellation of the Interpol red notice, noting: “Logically, my client should have come out free. The defense pleaded for his freedom with regard to the Interpol decision which canceled the red notice ”.
